1. ACCEPTANCE OF TERMS
By accessing and using PWR:PRODUCTS (the "Service"), you accept and agree to be bound by these Terms of Service ("Terms"). This agreement is between you and POWERPRODUCTS B.V., a private limited company registered in the Netherlands (KvK number: [pending registration]).
If you do not agree to these Terms, you may not access or use the Service. By placing an order or subscribing to our service, you confirm that you are at least 18 years of age and have the legal capacity to enter into this binding contract.
2. SERVICE DESCRIPTION
PWR:PRODUCTS is a precision nutrition subscription platform that provides:
• Personalized Product Packages: Customized combinations of protein supplements, vitamins, and creatine based on your weight, fitness goals, activity level, and dietary preferences
• Automated Monthly Delivery: Recurring shipments to ensure consistent nutrition support
• Subscription Management: Online dashboard to pause, modify, or cancel your subscription
Currently available for shipping within the Netherlands and European Union. We reserve the right to expand or restrict service areas without prior notice.
Products are sourced from trusted third-party manufacturers and partners. We curate high-quality supplements that meet our standards for purity, efficacy, and safety. Product formulations may change based on availability, scientific research, or supplier updates.
3. SUBSCRIPTION TERMS
• Subscriptions are billed monthly on the date you first subscribed
• Pricing ranges from €120-180/month depending on your personalized package
• All prices are in EUR and include applicable VAT (21% for Netherlands)
• Payment is processed via Stripe or Mollie before each shipment
Your subscription automatically renews each month until you cancel. You will be charged on your billing date unless you cancel at least 48 hours before the next billing cycle. We will send email reminders 7 days before each renewal.
We accept:
• Credit/debit cards (Visa, Mastercard, American Express)
• iDEAL (Netherlands)
• SEPA Direct Debit
• Other payment methods supported by Stripe/Mollie
Payment information is processed securely by our payment partners. We do not store your full card details on our servers.
If a payment fails, we will:
1. Notify you via email
2. Retry payment within 3 days
3. Pause your subscription if payment remains unsuccessful
4. Cancel your subscription after 14 days of non-payment
You are responsible for maintaining valid payment information and sufficient funds.
We reserve the right to adjust pricing due to changes in product costs, VAT rates, or operational expenses. You will be notified at least 30 days before any price increase. If you do not accept the new pricing, you may cancel your subscription before the change takes effect.
4. CANCELLATION & REFUND POLICY
You may cancel your subscription at any time via:
• Your profile dashboard
• Email to support@pwrproducts.com
Cancellations take effect at the end of your current billing cycle. You will continue to receive shipments for any period already paid.
If you are not satisfied with your first order, you may request a full refund within 30 days of delivery. To qualify:
• Return unused, unopened products in original packaging
• Contact us to initiate the return
• Ship products back to our return address (provided via email)
• Refunds are issued within 14 days of receiving returned products
Return shipping costs are covered by you unless the product was defective or shipped in error.
Orders after your first month are refundable only if:
• Products are damaged or defective upon arrival
• We shipped incorrect items
• You cancel before shipment (within 48 hours of billing)
We do not offer refunds for partially used products or buyer's remorse after the 30-day guarantee period.
You may pause your subscription for up to 3 months instead of canceling. Paused subscriptions do not incur charges and can be resumed at any time.
5. PRODUCT QUALITY & GUARANTEES
All products are:
• Sourced from reputable manufacturers with GMP (Good Manufacturing Practice) certification
• Third-party tested for purity and potency when available
• Stored in climate-controlled facilities to maintain freshness
• Shipped with at least 6 months until expiration date
Products are dietary supplements, not medicines. They are intended to support general health and fitness goals but do not diagnose, treat, cure, or prevent any disease. Always consult your physician before starting any supplement regimen, especially if you have medical conditions or take medications.
Product labels include allergen warnings. We make reasonable efforts to accommodate dietary restrictions (lactose-free, vegan, etc.) based on your preferences, but cross-contamination may occur during manufacturing. If you have severe allergies, review product labels carefully or contact us for detailed ingredient information.
If you receive damaged, expired, or defective products, contact us within 7 days of delivery. We will replace the product at no charge or issue a full refund. Include photos of the defect when reporting.
6. SHIPPING & DELIVERY
• Netherlands: 2-4 business days (PostNL)
• EU Countries: 5-10 business days (varies by country)
Shipping is included in your subscription price. We currently do not ship outside the EU.
If your package is lost or delayed beyond the estimated timeframe:
1. Check tracking information (sent via email)
2. Contact our support team
3. We will investigate with the carrier and resend or refund if necessary
You are responsible for providing an accurate delivery address. Address change requests must be submitted at least 72 hours before your next billing date.
Shipments within the EU are generally duty-free. However, some countries may apply local taxes or fees upon delivery. You are responsible for any such charges.
7. USER OBLIGATIONS
By using the Service, you agree to:
• Provide Accurate Information: Ensure all profile data (weight, activity level, preferences) is truthful and current for proper personalization• Maintain Account Security: Keep your login credentials confidential; you are responsible for all activity under your account
• Use Products Responsibly: Follow dosage recommendations; do not exceed suggested amounts without medical supervision
• Comply with Laws: Do not use the Service for illegal purposes or resell products commercially
• Respectful Communication: Treat our support team with professionalism; abusive behavior may result in service termination
We reserve the right to suspend or terminate accounts that violate these obligations.
8. INTELLECTUAL PROPERTY
All content on pwrproducts.com, including:
• Website design, logos, branding
• Personalization algorithms and recommendation logic
• Text, images, graphics, code
• Product descriptions and educational materials
...is owned by POWERPRODUCTS B.V. or licensed to us. You may not copy, modify, distribute, or create derivative works without written permission.
"PWR:PRODUCTS," the PWR logo, and related marks are trademarks of POWERPRODUCTS B.V. Unauthorized use is prohibited.
If you submit reviews, testimonials, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and promote such content.
9. LIMITATION OF LIABILITY
The Service is provided "as-is" without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or specific results from using our products.
To the fullest extent permitted by Dutch law, our total liability for any claims arising from your use of the Service is limited to the amount you paid in the 12 months preceding the claim.
We are NOT liable for:
• Indirect, incidental, or consequential damages
• Lost profits, revenue, or data
• Personal injury or health issues (unless caused by gross negligence or willful misconduct)
• Third-party actions (e.g., payment processor errors, carrier delays)
Supplements may interact with medications or pre-existing conditions. Consult a healthcare professional before use. We are not responsible for adverse reactions resulting from improper use or failure to disclose medical information.
Nothing in these Terms limits your statutory rights under Dutch or EU consumer protection laws.
10. DISPUTE RESOLUTION
If you have a complaint, please contact us at support@pwrproducts.com. We commit to responding within 5 business days and resolving issues amicably.
If informal resolution fails, we encourage mediation through the Dutch Disputes Committee for Distance Selling (Geschillencommissie Thuiswinkel) before pursuing legal action.
You may file complaints with:

11. GOVERNING LAW
These Terms are governed by the laws of the Netherlands, excluding conflict-of-law principles. Any legal disputes shall be resolved in the competent courts of Amsterdam, Netherlands.
For consumers within the EU, you retain the right to bring claims in your country of residence under applicable EU consumer protection directives.
12. CHANGES TO TERMS
We may update these Terms periodically to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated via:

Continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you do not agree, you may cancel your subscription before the effective date.
13. TERMINATION
You may cancel your subscription at any time as described in Section 4.
We reserve the right to suspend or terminate your account if you:
• Violate these Terms
• Engage in fraudulent or abusive behavior
• Provide false information
• Fail to pay subscription fees
We will provide notice when possible, but may terminate immediately in cases of serious violations.
14. MISCELLANEOUS
These Terms, along with our Privacy Policy, constitute the entire agreement between you and POWERPRODUCTS B.V. regarding the Service.
If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.
Our failure to enforce any right or provision does not constitute a waiver of such right or provision.
You may not transfer or assign your subscription without our consent. We may assign our rights to a successor entity in case of merger, acquisition, or sale.
